Terms of Service (Read before ordering)

Terms of Service ::

Artist Interpretation: By submitting a request to me for a commissioned piece you hereby give me-the artist-the right to interpret a piece however I see fit. If you commission me to draw a horse with a strange coat color (like, say, ‘Slow Molasses” or “Candyland Gumdrops“ ), I will listen to and consider any ideas you explain in your request, but it does not necessarily mean I will use them. If you have special markings in mind, etc, I will most certainly apply those to the image as best as I possibly can. If I feel your request overloads the image, is unreasonable/inappropriate, or is beyond my patience to draw, I will not accept your request. You are, however, free to discuss your ideas with me at any time during the initial planning period.

Request Submission: In your commission request I will need to know several things. First, what kind of service are you looking for? Color, custom head shot, bust, full body? Would you like a simple background, a complex one, no background at all? Are there any certain details that you would like to discuss with me? Any special markings or designs I should be aware of? Do you have something in mind but can’t place it solidly in writing yet? Do you need help planning your image? Please fill out the following application and note me with it.

Name: Your name.
Contact: How you can be reached. (Email, AIM, MSN, VHR/VP forum, DA-preferred)
Commission type: (Color, head, bust, full body, Background/No)
Animal: (Currently only doing equines. Please note me if interested in canines or monsters.)
Name: What is the name of your commissioned animal?
Coat: What is their coat color?
Eyes: What color are their eyes?
Breed type: What breed are they?
Build: What is their body type? (Long back, short legs, fat belly, trim, stocky, etc.)
Markings: Do they have leg whites or facial markings?
Other: Anything else you might want to discuss or have questions on.



Planning Period: During this drafting period I will be sketching out your request, working out small design flaws and generally preparing myself for the final product. If you have a complicated idea or request and would like to discuss it with me you are more than welcome to schedule a conference with me. This is the only window of time you have to change your mind about things contained within the image. After you accept the final draft you will be requested to pay an upfront deposit and will not be able to change anything further on the image.

Deposit: As of (12/28/08) I am requesting that all commissioners pay half of the price upfront upon accepting the final draft of their piece. I have had too many people request art, waste my time and then back out at the last moment and not pay me a cent of my due. This ’deposit fee’ is my insurance that something will be paid for the time and effort I put into the artwork and it is a non-refundable fee. If you choose to back out after paying the deposit you will not be refunded your money, it is mine to keep. If you follow through with the agreement you will pay the final half upon completion of the picture.

The Final Piece: I will not tolerate nit-picking of my images; if something is wrong with it due to your own fickle mind or forgetfulness while filling out the application I will withhold the image indefinitely and sell it elsewhere. I will not refund your upfront deposit if you decide you do not like the image. The only exception to this policy is a mistake of my own doing, in which case I will review the artwork and make a final decision on its quality and composition. The results of that review can either warrant a editing of the artwork or a full refund to the commissioner.

Pick Up: If the second half of the artwork isn’t claimed and paid for a week after my first notification, I withhold the right to do with it as I see fit. I can destroy it, tear it apart, eat it or sell it to somebody who really wants it. The commissioner waves any rights to the artwork or concept if I feel they have 'abandoned' the order.

Use: Once you have your copy of the final product, unless previously discussed with me (during the draft period)you are to use the artwork in ONE place at a time. You many not use it as run of the mill stock for every SIM horse you have or every layout you wish to make in the future. Remember that, even though you ordered and ' purchased ' this artwork, it is still my intellectual property. You are not to manipulate, redistribute, sell for monetary or game cash, claim as your own, hack it all to pieces or recolor it. Do not strip it back down into line art and try to get away with that, I will not have ANY of it.
